Hereinafter referred to as “Employee”.

WHEAREAS:

- Pursuant to the Labour Code and the relevant legal regulations, the Company and the Employee are entitled to negotiate the overtime work; and

- With the purposes that provide timely support for the Company’s manufacturing and business activities and help the Employee increase the income.

The Company and the Employee (hereinafter referred to as “Parties” and particularly as “Party”) agree to sign this Agreement on working overtime “Agreement” and commit to implement all of terms as follows:

Article 1: Agreement on Working Overtime

1.1. At any time when it is deemed that working overtime is needed, the Company will inform the Employee of the need for overtime work and the Employee shall hereby agree to work overtime.

1.2. In order to have the basis to calculate the overtime salary, the Employee shall first complete Form No. …. - Overtime Request, get the confirmation signature from the Line Manager and submit it to the Company’s Administrative - Human Resource Department.

1.3. The Company’s Administrative - Human Resource Department is responsible for receiving the Overtime Request, arranging and supervising the Employee’s overtime hours.

1.4. Total normal working hours and overtime working hours shall not be exceeded 12 (twelve) hours per day; the overtime working hours shall not be exceeded 30 (thirty) hours per month and not be exceeded 200 (two hundred) hours per year.

1.5. If the actual overtime hours are longer than the overtime hours as confirmed in the Overtime Request, the Employee shall supplement the new Overtime Request specifying the excessive overtime hours and having the confirmation signature from the Line Manager within the following working day to the Company’s Administrative - Human Resource Department.

1.6. The Company shall pay overtime salary to the Employee as specified in Article 4 of this Agreement if the overtime hours performed by the Employee matched the overtime hours recorded by the Company’s Attendance Record and complied with Articles 1.2 and 1.5 hereof.

Article 2: Rights of the Parties

2.1. Rights of the Company

  1. Building up the schedule of working overtime in accordance with the Company’s manufacturing and business need;
  2. Organizing, appointing and informing the Employee to work overtime and overtime hours in accordance with the Company’s manufacturing and business need; and
  3. All other legitimate rights specified in the Labour Contract, the Company’s registered internal labour regulations, and valid collective labour agreement, the Labour Code and the relevant legal regulations.

2.2. Rights of the Employee

  1. Being notified of the Company’s overtime work schedule in advance;
  2. Being paid fully and timely the overtime salary according to this Agreement;
  3. Proposing the Company to arrange the overtime hours in connection with the Employee’s ability; and
  4. All other legitimate rights specified in the Labour Contract, the Company’s registered internal labour regulations, and valid collective labour agreement, the Labour Code and the relevant legal regulations.

Article 3: Responsibilities of the Parties

3.1. Responsibilities of the Company

  1. Ensuring that the overtime hours applied to the Employee in accordance with the legal regulations;
  2. Notifying the Employee about the overtime working hours and schedule in order for the Employee to have time to arrange and work overtime; and
  3. Making fully and timely payment of the overtime salary for the Employee according to this Agreement.

3.2. Responsibilities of the Employee

  1. Working overtime according to the Company’s appointment and complying with the overtime working schedule as requested by the Company from time to time; and
  2. Complying with the provisions as stipulated in this Agreement and other legal regulations relating to working overtime.

Article 4: Overtime Salary

4.1. Based on prevailing regulations, the Company will make overtime payments to the Employee in accordance with the salary price unit or actual salary paid on the basis of the current work as follows:

  1. 150% of normal rate for weekdays;
  2. 200% of normal rate for weekends; and
  3. 300% of normal rate for public holiday, paid off-days, which is not included in public holiday pays, paid leave pays under the provisions of the Labour Code with respect to the Employee paid daily salary.

4.2. In addition to being paid for working at night in accordance with the law, the Employee works overtime at night shall be paid additional salary equal to 20% of the salary calculated on the salary price unit or actual salary paid for the work on the day of the normal working day or the weekly rest days or holidays.

4.3. Overtime payment shall be made at the same time with the Employees monthly salary payment period and be subject to tax and all kinds of statutory insurance contributions (if any) in accordance with the applicable law.

Article 5: General Regulations

5.1. This Agreement shall be governed or interpreted in accordance with the law of Vietnam.

5.2. This Agreement is made into 02 (two) original copies with equal validity. Each Party shall keep 01 (one) original copy. Where any addendum to this Agreement is concluded by the Parties, such addendum shall form an integral part of this Agreement and the content items of the addendum to this Agreement shall have the same validity with those of this Agreement.

5.3. This Agreement is made and signed at the head office of the Company on the above said date and takes effect since …./…./…... Any exception of this Agreement must be made with written approval of the Parties.

Câu hỏi: Người lao động được nghỉ hàng năm bao nhiêu ngày?

Trả lời:

Người lao động làm việc đủ 12 tháng cho một người sử dụng lao động thì được nghỉ hằng năm, hưởng nguyên lương theo hợp đồng lao động như sau:
12 ngày làm việc đối với người làm công việc trong điều kiện bình thường;
14 ngày làm việc đối với người lao động chưa thành niên, lao động là người khuyết tật, người làm nghề, công việc nặng nhọc, độc hại, nguy hiểm;
16 ngày làm việc đối với người làm nghề, công việc đặc biệt nặng nhọc, độc hại, nguy hiểm.
Người lao động làm việc chưa đủ 12 tháng cho một người sử dụng lao động thì số ngày nghỉ hằng năm theo tỷ lệ tương ứng với số tháng làm việc.

Câu hỏi: Tiền lương làm việc thêm giờ?

Trả lời:

 Người lao động làm thêm giờ được trả lương tính theo đơn giá tiền lương hoặc tiền lương thực trả theo công việc đang làm như sau:

- Vào ngày thường, ít nhất bằng 150%;

- Vào ngày nghỉ hằng tuần, ít nhất bằng 200%;

- Vào ngày nghỉ lễ, tết, ngày nghỉ có hưởng lương, ít nhất bằng 300% chưa kể tiền lương ngày lễ, tết, ngày nghỉ có hưởng lương đối với người lao động hưởng lương ngày.

Câu hỏi: Người lao động được xin nghỉ không hưởng lương bao nhiêu ngày?

Trả lời:

Theo sự thỏa thuận giữa Người lao động và người sử dụng lao động (Khoản 3 Điều 115 Bộ luật Lao động 2019).
