DECREE
DETAILING THE IMPLEMENTATION OF A NUMBER OF ARTICLES OF THE ORDINANCE ON THE STATE OF EMERGENCY IN CASE OF GREAT DISASTERS OR DANGEROUS EPIDEMICS

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the March 23, 2000 Ordinance on the State of Emergency;
At the proposals of the Minister of Justice, the Minister of Agriculture and Rural Development, the Minister of Science, Technology and Environment and the Minister of Health,
DECREES:
Chapter I
GENERAL PROVISIONS
Article 1.- Scope of regulation
This Decree prescribes in detail the organization of implementation of the National Assembly Standing Committee’s resolutions or State President’s orders promulgating the state of emergency in case of great disasters or dangerous epidemics (hereinafter called the state of emergency), and the application of special measures in the emergency state.
Article 2.- Principles for organization of implementation of the National Assembly Standing Committee’s resolutions or State President’s orders promulgating the state of emergency, and the application of special measures in the state of emergency
The organization of implementation of the National Assembly Standing Committee’s resolutions or State President’s orders promulgating the state of emergency, and the application of special measures must adhere to the following principles:
1. Ensuring the direct, all-sided and absolute leadership of the Communist Party of Vietnam;
2. Ensuring the concentrated and unified direction of the Prime Minister according to the provisions of the Ordinance on the State of Emergency and this Decree;
3. Giving priority to the rescue of people and properties of the State, agencies, organizations and people; giving priority to providing support and assistance to the seriously affected areas; minimizing the consequences caused by disasters and epidemics;
4. Absolutely abiding by and urgently, promptly executing decisions, orders and directives of the Prime Minister and the Steering Committee for implementation of the National Assembly Standing Committee’s resolutions or State President’s orders promulgating the state of emergency (hereinafter called the Steering Committee);
5. Mobilizing the combined strength of all forces, agencies, organizations and people to prevent, restrict and overcome the disasters’ or epidemics’ consequences;
6. Strictly prohibiting the taking of advantage of the state of emergency to infringe upon the State’s interests, the rights and legitimate interests of agencies, organizations and individuals.
Article 3.- Carrying reports on the state of emergency
1. Vietnam News Agency, the Radio Voice of Vietnam, Vietnam Television, the "Nhan Dan" (People) daily and the "Quan doi nhan dan" (People’s Army) daily shall have to immediately carry in full text the resolution of the National Assembly Standing Committee or the order of the State President promulgating the state of emergency as well as the Prime Minister’s decisions on organizing the implementation thereof; reporting in time on measures already taken in the geographical areas under the state of emergency and the situation of overcoming the disaster’s or epidemic’s consequences; and carry in full text the resolution of the National Assembly Standing Committee or order of the State President lifting the state of emergency.
The National Assembly Standing Committee’s resolution or State President’s order promulgating or lifting the state of emergency shall be posted up at the head offices of agencies, organizations and public-frequented places.
2. The other central and local newspapers, the local radio and television broadcasting stations and other mass media at the grassroots shall have to carry reports on the promulgation of the state of emergency and the process of overcoming the disasters’ or epidemics’ consequences.
