ABOUT THE SUSPENSION OF THE IMPORT OF USED MACHINERY, EQUIPMENT, AND TECHNOLOGY LINES

In the furtherance of the Government's Decree No. 12/2006/NĐ-CP dated January 23, 2006, detailing the implementation of the Law on trade applicable too international trading and the activities of agents, trading, processing, and transiting goods with other countries.
In compliance with the Prime Minister’s direction on the management of the import of used machinery, equipment, and technology lines in the Official Dispatch No. 571/TTg-KTTH dated April 27, 2012.

Awaiting the promulgation of legal documents on this issue, in order to prevent and manage the used machinery, equipment, and technology lines in accordance with the Prime Minister’s direction, after reaching the obtaining the agreement from the Ministry of Industry and Trade, the Ministry of Finance (the General Department of Customs), the Ministry of Science and Technology announces:
1. To suspend the import of used machinery, equipment, and technology lines that have been discarded by competent agencies of China (2,255 enterprises) belonging to the following disciplines:
- Production of iron, steel, alloy, fine coal;
- Production of copper, lead, zinc, aluminum electrolysis;
- Production of calcium carbide, chemical fiber, cement, flat glass;
- Production of paper, alcohol, monosodium glutamate, citric acid;
- Tanning, dyeing, and printing.
More detailed information in the Official Dispatch No. 2035/BKHCN-KHTC dated August 25, 2011 of the Ministry of Science and Technology on the announcement of China about discarding 2,255 obsolete enterprises, promulgated together with this Announcement.
2. Since September 15, 2012, the Ministry of Finance must guide the General Department of Customs to only grant the customs clearance to the consignments of used machinery, equipment, and technology lines originated from China that  have been certified by the Ministry of Science and Technology that they are not suspended from import as prescribed in Clause 1 this Announcement.
The importer must send the following documents to the Ministry of Science and Technology for certifying that the machinery, equipment, and technology lines are not suspended from import:
- The import dossier as prescribed;
- The documents proving the origins of machinery, equipment, and technology lines (specifying the date of production, place of origin, the first year of use, the location and unit that uses them before the import).
