CIRCULAR
PROMULGATING THE LIST OF LIKELY UNSAFE PRODUCTS AND GOODS UNDER THE INDUSTRY AND IVADE MINISTRY'S MANAGEMENT
THE MINISTRY OF INDUSTRY AND TRADE
 
Pursuant to the Government's Decree No. 189/2007/ND-CP of December 27, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the November 21, 2007 Law on Product and Goods Quality;
Pursuant to the Government's Decree No. 132/2008/ND-CP of December 31, 2008, detailing a number of articles of the Law on Product and Goods Quality (below referred to as Decree No. 132/2008/ND-CP);
The Ministry of Industry and Trade promulgates the list of likely unsafe products and goods under the Industry and Trade Ministry's state management and provides the principles of their quality control as follows;
Article 1. Scope of adjustment
This Circular promulgates the list of likely unsafe products and goods (below referred to as the list of group-2 products and goods) specified at Point e, Clause 2, Article 32 of the Government's Decree No. 132/2008/ND-CP under the Industry and Trade Ministry's management and provides the principles of state management of the quality of products and goods on this list.
Article 2. Subjects of application
1. Organizations and individuals producing and trading in products and goods on the list of group-2 products and goods specified in the Appendix to this Circular.
2. State management agencies related to product and goods quality and other concerned agencies and organizations.
3. Conformity assessment organizations designated to examine, verify and test the quality of products and goods on the list of group-2 products and goods (below referred to as designated conformity assessment organizations).
Article 3. Principles of quality control
The control of quality of products and goods on the list of group-2 products and goods under the Industry and Trade Ministry's management specified in this Circular must comply with the principle that products and goods, before being marketed, must obtain certification of conformity with relevant technical regulations promulgated by the Ministry of Industry and Trade. In case of unavailability of relevant technical regulations, control shall be conducted under current regula­tions until relevant technical regulations are issued.
Article 4. The list of group-2 products and goods under the Industry and Trade Ministry's management
The list of group-2 products and goods under the Industry and Trade Ministry's management is provided in an Appendix to this Circular.
