CIRCULAR
ON ADDING NEW SPECIES TO THE LIST OF PROTECTED SPECIES
Based on the Decree No. 01/2008/ND-CP on January 3rd 2008 of the Government for stipulation of functions, duties of the Ministry of Agriculture and Rural Development;
Based on the Intellectual Property Law No. 50/2005/QH11, dated on 29th November 2005;
According to the Decree No. 104/2006/ND-CP in September 22nd 2006 on detailed regulations to implement some articles in the Intellectual Property Law on Plant Variety Rights.
According to proposal of the Director General of the Department of Crop Production (DCP); Ministry of Agriculture and Rural Development promulgate the Circular on adding some species into the List of protected species as follow:
Article 1. Issuing with this Circular some new genus and plant species following to the List of protected species:

8. Song doi (cay bong) and its hybrid
Kalanchoe blossfeldiana Poelln.
9. Hoa Giay and its hybrid
Bougainvillea.
10. Rong ro
Calathea.
11. Chi diep (Luoi mac)
Lactus sp.
Article 2. Depend on the cases, methods for DUS Test will be selected by the Department of Crop Production for properly DUS Test result.
Article 3. This Circular enter into force after 45 days from signing date.
Article 4. Director of MARD Office, Department of Crop Production, Department of Science, Technology and Environment, Provincial Department of Agriculture and Rural Development in province level and cities under central government, Director of Plant Variety Protection Office and Leaders of relevant offices are responsible to implement of this Circular./.
