Circular No. 34/2013/TT-BCT dated of December 24, 2013 of the Ministry of Industry and Trade publicizing the roadmap for the trading of goods and activities directly related to the trading of goods by foreign-invested enterprises in Vietnam

Circular No. 34/2013/TT-BCT dated of December 24, 2013 of the Ministry of Industry and Trade announcing the schedule for implementation of trading rights and activities directly related to trading rights of foreign-invested enterprises in Vietnam

Pursuant to Government's Decree 95/2012/ND-CP on the functions, tasks, powers and organization of the Ministry of Industry and Trade;

Pursuant to the National Assembly's Resolution 71/2006 dated 29^th November 2006 ratifying the Protocol on Viet Nam's accession to the WTO;

Pursuant to the Government's Decree 23/2007/ND-CP dated 12^th February 2007 detailing the Commercial Law on trading rights and activities directly related to trading rights of foreign-invested enterprises in Viet Nam;

Pursuant to the Government's Decree 108/2006/ND-CP dated 22^nd September 2006 detailing and guiding the implementation of Law on Investment;

At the proposal of the Director General of the Planning Department;

Minister of Industry and Trade hereby promulgate this Circular to announce the schedule for implementation of trading rights and activities directly related to trading rights of foreign-invested enterprises in Viet Nam;

Article 1: Scope of application

This Circular announces the schedule and regulations for implementation of Viet Nam's commitments in the WTO on trading rights and activities directly related to trading rights of foreign-invested enterprises in Viet Nam.

Article 2: The execution of export, import and distribution rights of foreign-invested enterprises in Viet Nam.

1. Foreign-invested enterprises in Viet Nam are entitled to exporting rights of goods which are not listed in Annex 1 of this Circular.

2. Foreign-invested enterprises in Viet Nam are entitled to importing rights of goods which are not listed in Annex 2 of this Circular.

3. Foreign-invested enterprises in Viet Nam are entitled to distribution rights of goods which are not listed in Annex 3 of this Circular.

4. The execution of exporting, importing and distribution rights of foreign-invested enterprises in Viet Nam must comply with provisions of this Circular and other existing legal normative documents.

Article 3: Principles of using lists of goods

1. The classification of goods listed in Annex 1, 2 of this Circular is executed based on the Viet Nam's list of imported – exported goods which is issued together with Circular 156/2011/TT-BTC dated 14^th November 2011 by Ministry of Finance.

2. Where such Circular 156/2011/TT-BTC is amended, supplemented or replaced, the execution will be based on new provisions.
