1. The procedure of separation of land use right certificates:

+ The land user submits the dossier at the Division of Natural Resources and Environment;

+ Within a day of receiving complete and valid dossiers or at the latest next working day, the Division of Natural Resources and Environment shall have to send the dossier to the land use right registration office to prepare the cadastral dossier.

+ For land separations that require land cadastral measurements, within 7 (seven) working days after receiving the land use right registration dossiers, the Land Use Right Registration Office shall be responsible for making the cadastral measurements of the newly split land, making an extract of the cadastral map, extracting the cadastral file and sending it to the Natural Resources and Environment agency at the same level;

+ Within three (3) working days from the date of receipt of the extract of the cadastral map, the extract of the cadastral file, the Division of Natural Resources and Environment shall be responsible for submitting the district-level People's Committee to sign the certification for new land plots;

+ Within three (03) working days from the date of receipt of the submission, the district-level People's Committee shall consider, sign and send the certificate to the Division of Natural Resources and Environment;

+ Within the date of receipt of the signed certificate or within the next working day, the Division of Natural Resources and Environment shall be responsible for handing over the original certificate to the new land plot for the land user.

2. Composition and number of dossiers:

The dossier includes:

+ An application for splitting one land plot into several land plots or consolidating multiple land plots into one land plot
+ One of the documents on land use right (if any) includes:
a) Documents on the right to use land before October 15, 1993, granted by competent agencies in the course of implementing the land policies of the Democratic Republic of Vietnam, the Provisional Revolutionary Government of the Republic of South Vietnam and the State of the Socialist Republic of Vietnam;
b) Temporary land use right certificate issued by a competent state agency or registered in the land register or cadastral book;
c) Lawful papers on inheritance, donation of land use rights or assets attached to land; papers of affection houses attached to land;
d) Papers on the transfer of land use rights, purchase and sale of residential houses attached to residential land before October 15, 1993 and now certified by the commune/ ward/township People's Committees as having been used before the 15th of the month 10 years 1993;
đ) Papers on liquidation or price of houses attached to residential land according to law provisions;
e) Documents issued by the competent agency of the old regime to the land user.
f) Households and individuals currently using land with one of the above-said papers (from (a) to (e), on which the name of another person is inscribed, enclosed with the papers on transfer of land use rights. signed by concerned parties, but before July 1, 2004, the procedures for land use right transfer have not yet been carried out according to the provisions of law and now certified by the commune/ward/township People's Committees is land without dispute.
g) Households and individuals are entitled to use land according to the judgment or decision of the People's Court, the judgment execution decision of the judgment enforcement body, the decision on resolution of land dispute by the State agency Authority has been enforced.
