DECISION

ON AMENDING AND SUPPLEMENTING SOME OF ARTICLES OF THE DECISION NO. 315/QD-TTG DATED MARCH 01, 2011 OF THE PRIME MINISTER ON THE PILOT IMPLEMENTATION OF AGRICULTURAL INSURANCE DURING 2011- 2013

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated  December 25, 2001;

Pursuant to the Law on insurance business dated December 09, 2000;

Pursuant to the Resolution No. 24/2008/NQ-CP dated October 28, 2008 of the Government promulgating “the Government's action program board for the Resolution’s implementation of the 7^th Plenum of the X^th Party Central Committee on agriculture, farmers and rural areas”;

At the proposal of the Minister of Finance,

DECIDES:

Article 1. To amend and supplement some of articles of the Decision No. 315/QD-TTg, of March 01, 2011 of the Prime Minister on the pilot implementation of agricultural insurance during 2011- 2013 as follows:

1. To amend Point b, Clause 2 Article 1, as follows:

“b) To support 90% of insurance premiums for farmer households and farmers living just to the poverty line  participate in agricultural insurance”.

2. To supplement Clause 9 to Article 1 as follows:

“9. Farmer households, farmers, organizations that participate in pilot agricultural insurance for domestic animals in accordance with this Decision still are enjoyed support mechanisms and policies under the Decision No. 719/QD-TTg, dated June 05, 2008 of the Prime Minister on the support policy for prevention, combat of epidemic disease of cattle, poultry; Decision No. 1442/QD-TTg dated August 23, 2011 of the Prime Minister, on amending and supplementing a number of articles of the Decision No. 719/QD-TTg dated June 05, 2008 of the Prime Minister on the support policy for prevention, combat of epidemic disease of cattle, poultry; Decision No. 142/2009/QD-TTg, dated December 31, 2009 of the Prime Minister on mechanism, policies of support of plant varieties, livestock, fisheries for production restoration of areas damaged by natural disasters, epidemics and Decision No. 49/2012/QD-TTg dated November 08, 2012 of the Prime Minister on amending and supplementing the Article 3 of the Decision No. 142/2009/QD-TTg of the Prime Minister on mechanism, policies of support of plants, livestock, fisheries for production restoration for damaged areas damaged by natural disasters, epidemics.

Based on the actual insurance compensation level, Chairmen of the People’s Committee of provinces, cities in pilot localities shall decide the specific level to directly support farmer households, farmers, organizations, ensuring total of insurance compensation levels and direct support levels for domestic animals damaged by disaster, epidemics in the principle that not exceeding the economic value of domestic animals at time of damage.”

3. To amend Clause 1, Article 3 as follows:

“1. This Decision takes effect on the signing date. These insurance contracts shall be signed to the end of  December 31, 2013; summarized  and evaluated before June 30, 2014”.

Article 2. This Decision takes effect on the signing date.

Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairmen of People's Committees of provincial-level and municipal cities (which are selected for pilot implementation of agricultural insurance) shall implement this Decision.
