DECISION
ANNOUNCEMENT OF BOAT GUIDING LINE IN THE COMPULSORY MARINE PILOTAGE AREA OF VIETNAM AND REGULATION ON MINIMUM NUMBER OF PILOTS OF DIFFERENT CLASSES, MEANS OF TRANSPORTATION OF PILOT WITH EACH BOAT GUIDING LINE

Pursuant to the Vietnam Maritime Code dated June 14, 2005;
Pursuant to Decree No. 173/2007/ND-CP of November 28, 2007 of the Government stipulating the organization and operation of maritime pilots and Decree No. 49/2011/ND-CP of June 21, 2011 of the Government amending and supplementing Article 11 of Decree No. 173/2007/ND-CP;
Pursuant to Decision No. 26/2009/QD-TTg dated February 20, 2009 of the Prime Minister of the Government stipulating functions, tasks, powers and organizational structure of the Vietnam Maritime Administration directly under the Ministry of Transport;
Pursuant to Circular No. 58/2011/TT-BGTVT dated November 28, 2011 of the Minister of Transport stipulating the compulsory maritime pilotage area of Vietnam;
Pursuant to Circular No. 06/2009/TT-BGTVT of June 18, 2009 and Circular No. 10/2011/TT-BGTVT dated March 25, 2011 of the Minister of Transport, amending and supplementing a number of articles of Circular No. 06/2009/TT- BGTVT stipulating the training, grant and revocation of the certificate of professional capacity of maritime pilot and Certificate of operation area of maritime pilots;
At the proposal of the Head of Legal Affairs Division.
DECIDES
Article 1.
Issuing together with this Decision the list of boat guiding line in the compulsory maritime pilotage area of Vietnam and the minimum number of pilot ratings, means of transportation of pilot with each boat guiding line.
Article 2.
1. Boat guiding line is the route of boat guided by the pilot from the pilot reception area to wharf, port, anchorage, transshipment area, storm shelter, shipyard (hereafter referred to as port) of a sea port or offshore oil port in a compulsory pilotage area.
2. Means of pilot transportation are boat eligible for reception of pilot safely as prescribed and in accordance with the actuality of that boat guiding line.
3. Maritime pilot organization must meet the minimum number of pilot ratings and means of pilot reception specified in the Appendix issued together with this Decision in order to provide timely, efficient and safe pilotage service on the boat guiding line assigned. In case the pilot organization is assigned from 02 (two) boat guiding lines or more but the demand for boat guiding is not regular, then the minimum number of pilot ratings, means of pilot reception for those boat guiding lines can be reduced by the decision of the Director of Vietnam Marine Administration.
