DECREE
PROMULGATING THE REGULATION ON MANAGEMENT AND USE OF FOREIGN NONGOVERNMENTAL AID
THE GOVERNMENT
Pursuant to the December 25, 2001 Law on Organization of the Government;
At the proposal of the Minister of Planning and Investment,
At the proposal of the Minister of Planning and Investment,
DECREES:
Article 1. To promulgate together with this Decree the Regulation on management and use of foreign non-governmental aid.
Article 2. This Decree takes effect on January 1, 2010, and replaces the Prime Minister's Decision No. 64/2001/QD-TTg of April 26, 2001, promulgating the Regulation on management and use of foreign nongovernmental aid.
Article 3. The Minister of Planning and Investment and the Minister of Finance shall guide and inspect the implementation of this Decree.
Article 4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People's Committees, heads of political, sociopolitical and socio-political-professional organizations, and concerned organizations and individuals shall implement this Decree.

Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
1. This Regulation regulates the management and use of foreign non-governmental aid sources.
Foreign non-governmental (FNG) aid mentioned in this Regulation means nonrefundable aid provided for not-for-profit purposes by donors for Vietnam to achieve development and humanitarian objectives.
2. Donors referred to in this Regulation include foreign non-governmental organizations and other foreign organizations and individuals, including foreign-invested groups and companies and overseas Vietnamese community that respect and observe Vietnamese law and have goodwill and directly provide non-refundable aid to support Vietnam's socio-economic development and humanitarian objectives.
