JOINT CIRCULAR
GUIDING THE NOTIFICATION AND CONTROL OF CONSTRUCTION-MATERIAL PRICES IN THE CONSTRUCTION INVESTMENT DOMAIN
Pursuant to the Government's Decree No. 52/1999/ND-CP of July 8, 1999 promulgating the Regulation and Investment and Construction Management; Decree No. 12/2000/ND-CP of May 5, 2000 amending and supplementing a number of articles of the Regulation and Investment and Construction Management, promulgated together with the Government's Decree No. 52/1999/ND-CP of July 8, 1999; and Decree No. 07/2003/ND-CP of January 30, 2003 amending and supplementing a number of the Regulation and Investment and Construction Management, promulgated together with the Government's Decree No. 52/1999/ND-CP of July 8, 1999 and Decree No. 12/2000/ND-CP of May 5, 2000;
Pursuant to the Government's Decree No. 170/2003/ND-CP of December 25, 2003 detailing the implementation of a number of articles of the Price Ordinance;
Pursuant to the Government's Decree No. 77/2003/ND-CP of July 1, 2003 defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Government's Decree No. 36/2003/ND-CP of April 4, 2003 defining the functions, tasks, powers and organizational structure of the Ministry of Construction;
In order to manage expenditures in construction investment, the Ministry of Finance and the Ministry of Construction hereby jointly guide the notification and control of construction-material prices in the construction investment domain for construction works as follows:
I. OBJECTS AND SCOPE OF REGULATION
This Circular guides the notification and control of construction-material prices in the construction investment domain for investment projects on construction of works using the State budget capital, the State-guaranteed credit capital, the State's development investment credit capital, State enterprises' development investment credit capital and other capital sources which are borrowed and paid by State enterprises themselves without the State's guarantee, prescribed in Articles 10, 11 and 12 of the Government's Decree No. 52/1999/ND-CP of July 8, 1999 promulgating the Regulation on Investment and Construction Management; Clauses 4, 5 and 6, Article 1 of the Government's Decree No. 12/2000/ND-CP of May 5, 2000 and Clauses 4, 5 and 6, Article 1 of the Government's Decree No. 07/2003/ND-CP of January 30, 2003. Besides, investment projects on construction of works using capital sources other than those mentioned above are encouraged for the application of this Circular's provisions.
For centrally-managed construction works which are built in any locality, the prices notified by such locality shall apply.
