Official Dispatch No. 1315/BNN-TT dated April 22, 2014 of the Ministry of Agriculture and Rural Development on guidelines for Decree No. 202/2013/ND-CP and Decree No. 187/2013/ND-CP

In response to the Official Dispatch No. 3302/TCHQ-GSQL dated March 31, 2014 of the General Department of Customs, which requests the Ministry of Agriculture and Rural Development to provide guidelines for the Decree No. 202/2013/ND-CP dated November 27, 2013, the Ministry of Agriculture and Rural Development hereby offers some opinions:
1. On November 27, 2013, the Government promulgated the Decree No. 202/2013/ND-CP on fertilizer management, which comes into force on February 01, 2014. According to the Decree, the Ministry of Industry and Trade is in charge of management of inorganic fertilizers, which the Ministry of Agriculture and Rural Development is in charge of management of organic fertilizers and other fertilizers. The Ministry of Agriculture and Rural Development is now drafting a Circular to provide guidelines for the Government's Decree No. 202/2013/ND-CP dated November 27, 2013 and relevant National Technical Regulations within the given tasks.
Before such Circular is promulgated, under an agreement with the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade has promulgated a Dispatch No. 2114/BCT-HT dated March 19, 2014 on implementation of the Government's Decree No. 202/2013/ND-CP on fertilizer management. Guidance on the procedures related to both inorganic fertilizers, organic fertilizers, and other fertilizers under the management of both Ministries is provided in Point 2 of such Dispatch. Two lists of fertilizers for which certification of conformity and declaration of conformity are compulsory are also enclosed therewith.
On March 31, 2014, Department of Crop Production issued the Dispatch No. 512/TT-QLCL on certification of conformity and declaration of conformity of organic fertilizers and other fertilizers according to the Decree No. 202/2013/ND-CP on temporary guidance on certification of conformity and declaration of conformity of organic fertilizers and other fertilizers.
