1. Why should you register the inventions in the area of hydraulic engineering, foundations and soil-shifting?

2. What is an invention in the area of hydraulic engineering, foundations and soil-shifting?

According to the provisions of the Vietnamese intellectual property law, an invention can be defined as a technical solution that applies the natural laws with the purpose of resolving specific issues. This technical solution can be a new material, product or a new machine, apparatus, method and process that is applied for a particular work.

An invention can be protected in the form of being granted an Invention Patent or Utility solution Patent, depending on its nature, on the condition that it meet the following general requirements:

- It is new;

- It is creative;

- It is capable of industrial application.

- General working methods with dredgers or soil-shifting machines;

- Equipment for conveying or separating excavated material;

3. How to register the inventions in the area of hydraulic engineering, foundations and soil-shifting in Vietnam?

Provisions of the Vietnamese intellectual property law require a registration dossier for inventions in the area of hydraulic engineering, foundations and soil-shifting shall inculde the following documents and papers:

- Application Form of the Invention (02 copies);

- Detail Explanation of the Invention (02 copies);

- Brief Summary of the Invention (02 copies and these copies can be submitted later);

- Protection Request of the Invention (02 copies);

- Payment receipt of the submitting fees (if any);

- Other related documents for particular cases such as the documents to prove the priority right, the right to register (if any), or power of attorney (if any), etc.

4. The process of registration for inventions in the area of hydraulic engineering, foundations and soil-shifting in Vietnam?

Generally, an invention registration application for inventions in the area of hydraulic engineering, foundations and soil-shifting shall be submitted and examined through procedures as below:

Stage 1: Submitting the application to NOIP office in Ha Noi or its representative offices in Da Nang and Ho Chi Minh City (directly or indirectly via post).

Stage 2: Examination of the application in terms of formal requirements.

Stage 3: Publication of the valid application in the Industrial Property Official Gazette.

Stage 4: Examination of the application in terms of its content.

Stage 5: Issuance of the Invention/Utility solution Patent.
