1. Why should you register the inventions of combustion engines, hot-gas or combustion-product engine plants?

2. What are inventions of combustion engines, hot-gas or combustion-product engine plants?

There are actually two types of invention that are recognized by law: invention and utility solution. An invention/utility solution is a technical solution that is invented by man in the form of a product or a process to solve a number of identified problems through the application of natural laws. Invention/utility solution registration is an administrative procedure processed by the National Office of Intellectual Property (NOIP) to determine ownership of a certain subject to an invention/utility solution.

According to the intellectual property law, a technical solution is an invention/utility solution only when it meets the general requirements as below:

- It is new;

- It is creative; and

- It is capable of industrial application.

When registering an invention, the invention will be described and sorted out into certain Classes according to the International Patent Classification (IPC) based on the characteristics of the invention. According to the newest version of the IPC, inventions of combustion engines, hot-gas or combustion-product engines plants are classified into Class F02, Section F. This Class mainly contains the following areas of technical solutions:

- Internal-combustion piston engines; combustion engines in general;

- Gas-turbine plants; air intakes for jet-propulsion plants; controlling fuel supply in air-breathing jet-propulsion plants;

- Controlling combustion engines;

- Cylinders, pistons, or casing for combustion engines; arrangements of sealings in combustion engines;

- Hot-gas or combustion-product positive-displacement engines plants;

- Use of waste heat of combustion engines;

- Jet-propulsion plants;

- Supplying of combustion engines; starting aids for such engines;

- Ignition, other than compression ignition, for internal-combustion engines; testing of ignition timing in compression ignition engines;

3. How to register the inventions of combustion engines, hot-gas or combustion-product engine plants in Vietnam?

A dossier for registration inventions of combustion engines, hot-gas or combustion-product engines plants in Vietnam shall include the following documents and papers:

- 02 registration forms, made in accordance with the prescribed form;

- 02 detail descriptions of the invention, including illustrations of the invention (if any);

- Request of protection for the invention;

- Receipt of payment of fees;

- A contract or a letter of authorization for the representative organization to file the application (if the application owner authorizes an industrial property representative organization)

4. The process of registration for inventions of combustion engines, hot-gas or combustion-product engine plants in Vietnam?

The applicant shall file the invention registration application to the NOIP in Ha Noi or representative offices of NOIP in Da Nang city or Ho Chi Minh city, wherever it is convenient. After that, the NOIP will appraise the application through the following process:

Stage 1: Appraisal of the form of the patent application (about 01 month).

Stage 2: Publication of the patent application in the Industrial Property Official Gazette (normally 18 months from the submitting date).

Stage 3: Appraisal of the content of the patent application (normally 18 months from the publishing date).

Stage 4: Issuance of an Invention/Utility solution patent, (about 03 months after the applicant paid all the fees and charges promptly).
