2. What are inventions of machines or engines for liquids, wind, spring or weight motors?

According to the Vietnamese intellectual property, there are two types of patents: invention patent and utility solution patent. An invention/utility solution is basically a technical solution which was invented in the form of a product or a process or a solution to solve particular problems by applying natural laws.

Technical solutions can be registered as inventions/utility solutions only when they satisfy the following general conditions:

When registering an invention, based on the nature of the invention, it will be sorted out into specific Classes according to the International Patent Classification (IPC). 3. How to register inventions of machines or engines for liquids, wind, spring or weight motors in Vietnam?

In order to be accepted in Vietnam, a dossier for registration inventions of machines or engines for liquids, wind, spring or weight motors shall have documents and papers as below:

- 02 patent registration forms (in accordance with the prescribed form);

- 02 patent descriptions in detail, (including diagrams (if any));

- 02 Request of invention protection;

- Fees payment receipt;

- Power of attorney (in case of applying through an industrial property representative organization)

4. The process of registration for inventions of machines or engines for liquids, wind, spring or weight motors in Vietnam?

The patent application can be filed directly or indirectly via post to the NOIP in Ha Noi or representative offices of NOIP in Da Nang city or Ho Chi Minh city. Then, the application will be appraised by the NOIP through the following stages:

Stage 1: Examination of the form of the application (within 01 month).

Stage 2: Publication of the application information in the Industrial Property Official Gazette (normally after 18 months since the submitting date).

Stage 3: Examination of the content of the application (normally within 18 months from the publishing date).

Stage 4: Issuance of the protection title (about 03 months since the date applicant pay all the state fees promptly).
