1. What is the invention of tools and process in printing?

Vietnamese intellectual property law currently defines inventions as technical solutions in the form of products or process that apply natural principles in order to resolve particular issues in our life. When applying for a patent, an invention can be granted an Invention patent or Utility solution patent, depending on the nature of the invention.

An Invention patent is granted when the following conditions are satisfied:

- The invention is novel;

- The invention is creative;

- The invention is susceptible of industrial application.

A Utility solution patent is granted if the invention meets the following conditions:

- The invention is not common knowledge;

- Processes for the manufacture or reproduction of printing surfaces;

- Bookbinding machines, devices or tools;

- Books, book covers, loose leaves,

- Implements for writing or drawing

- Decorative arts;

- Machines, apparatus or tools for artistic work, for example for sculpturing, guilloching, carving, branding or inlaying;

- Special designs or pictures.

2. Why should you register the inventions of tools and process in printing in Vietnam?

3. How to register the inventions of tools and process in printing in Vietnam?

The dossier of inventions registration for tools and process in printing shall be prepared with the following documents according to the provisions of Vietnamese intellectual property law:

- 02 copies of Invention Registration Application form (in accordance with the prescribed form);

- 02 copies of invention description;

- 02 copies of Request for Protection of invention/utility solution;

- Receipts of state fees and charges;

- Power of attorney (if applied through an industrial property representative);

- Transfer contract of the right to apply (if any);

- Documents certifying the right to registration (if beneficiary from others);

- Documents proving the priority (if the invention registration application requires priority right).

4. Procedures of registration of inventions of tools and process in printing in Vietnam?

The state agency that is competent to evaluate and issue a patent is the National Office of Intellectual Property. The applicant may file the registration application directly or via postal service to the official address of NOIP, or to one of representative offices of NOIP in Ho Chi Minh City or Da Nang City.

After the applicant submits the dossier, the NOIP will start to evaluate the invention registration application through the following steps:

First step: Evaluate the form of the application

Second step: Publish the application information in the Industrial Property Official Gazette

Third step: Evaluate the content of the application

Fourth step: Grant and record the Patent for the invention
