THE NATIONAL ASSEMBLY
Resolution No. 41/2009/QH12 dated November 25, 2009 of the National Assembly on approving investment in Ninh Thuan nuclear power project
Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;
Pursuant to Resolution No. 66/2006/QH11 of June 29, 2006, of the XIth National Assembly, the 9th session, on important national projects and works to be submitted to the National Assembly for investment approval;
Pursuant to the June 3, 2008 Law on Atomic Energy;
After considering the Government's Report No. 08/TTr-CP of September 30, 2009; Verification Report No. 739/BC- UBKHCNMT12 of October 20, 2009, of the National Assembly's Committee on Science, Technology and Environment; the Government's Additional Report No. 15/TTr-CP of October23,2009; other Government reports on the proposal on investment in Ninh Thuan Nuclear Power Project, and opinions of National Assembly deputies;
RESOLVES:
Article 1.
To approve investment in Ninh Thuan Nuclear Power Project, including two plants each having two engine groups, to supply electricity for the national power grid, contributing to the socio-economic development of the country and Ninh Thuan province.
The site of construction: Ninh Thuan nuclear power plant 1 will be located in Phuoc Dinh commune. Thuan Nam district. Ninh Thuan province; and Ninh Thuan nuclear power plant 2 in Vinh Hai commune, Ninh Hai district, Ninh Thuan province.
Article 2.
Below are several basic parameters of the Project:
1. The Project's scope: The capacity of two plants will be over 4.000 megawatts (MW) suitable to the selected technology and furnace generation, with the capacity of Ninh Thuan nuclear power plant 1 to be about 2,000 MW and that of Ninh Thuan nuclear power plant 2 to be about 2,000 MW;
2. Main technology: Light water reactors of the most modern generation, already checked, to ensure absolute safety and economic efficiency at the time of formulation of the investment project;
3. Construction land area: To use land in the most appropriate and thrifty manner;
4. Total investment: estimated at VND 200 trillion (at the time of formulation of the Project in the 4'" quarter of 2008);
5. Implementation time and roadmap:
- To commence construction of Ninh Thuan nuclear power plant 1 by 2014. and put the first engine group into operation by 2020.
- Based on the preparation situation, the Government shall report to the National Assembly for decision on the time to commence construction of Ninh Thuan nuclear power plant 2.
Article 3.
To assign the Government to decide on the project investment and implementation to meet the following major requirements and tasks:
1. To promptly finalize and approve master plans and fully and comprehensively promulgate legal documents and technical standards and regulations on construction, management, operation and exploitation of nuclear power plants;
2. To calculate work designs according to special standards, ensuring the highest security and safety. To study and fully assess impacts of geological formation faults and phenomena of climate change and sea level rise in the project implementation area; to elaborate and approve the Project's environmental impact assessment report according to regulations;
3. To elaborate detailed plans for the relocation and resettlement of local inhabitants and properly organize the implementation thereof, and construct infrastructure facilities serving the Project, ground area and auxiliary structures serving the construction of the plants;
4. To adopt policies prioritizing the construction of infrastructure facilities for developing economic, cultural, educational and social welfare activities in the areas of the plants under Article 5 of the Law on Atomic Energy;
