a. The procedure

- Receive the applications: Complaints may be submitted directly or by post to the National Office of Intellectual Property in Hanoi or two representative offices of the Department in Ho Chi Minh City and Da Nang.

- Complaint handling: Check the application form requirements (the reason for the complaint, the decision complained, the time limit for the complaint, the complainant, the person concerned), and issue a notice to the complainant about the acceptance/non-acceptance of the complaint (clearly stating the reason).

- Issue a settlement decision: Based on the arguments and evidence of the complainant and the related party, the National Office of Intellectual Property shall issue a decision on the settlement of the complaint.

- The announcement of the decision: The decision on the settlement of the complaint shall be published in the Industrial Property Gazette.

b. Method to submit the complaint:

- Directly at the headquarters of the National Office of Intellectual Property in Hanoi or 2 representative offices of the Department in Ho Chi Minh City and Da Nang.

c. Composition, number of dossiers:

- The composition of the file, including:

+ Declaration (02 sheets as provided form);

+ Written explanation of the complaint and evidence proving the arguments of the complaint;

+ A copy of the decision or notice of complaint filed by the National Office of Intellectual Property;

+ A copy of the first complaint settlement decision (for the second complaint);

+ Letter of authority (if the application is filed through a representative);

+ Receipt of fees and charges.

- Number of dossiers: 01 set

d. Processing time: 10 days from the date of receipt.

g. Results of implementation of administrative procedures: Decision on settlement of complaints.

h. Fee

- Fee for searching information in service of evaluation, assessment and other tasks within the scope of responsibility:

+ Inventions (including utility solutions): 120,000 VND;

+ Industrial design: VND 120,000;

+ Trademark: VND 60,000, if the trademark application contains more than 6 products/services in a group, must pay more for each product/service from 7 onwards: 24,000 VND;

+ Geographical indications (including appellations of origin): VND 60,000.

- Charge for search of associated trademarks in service of evaluation of dossiers of registration of contracts for the transfer of industrial property rights (each trademark): VND 60,000.

- Fee for requesting information related to industrial property object (per request of an object):

+ Inventions (including utility solutions): VND 200,000;

+ Industrial design: VND 200,000;

+ Brand: 100,000 VND;

+ Geographical indications (including appellations of origin of goods): VND 100,000;

+ Integrated circuit layout design: 100,000 VND.

- Charge for evaluation, solicitation of expertise of industrial property objects:

+ Inventions (including utility solutions): VND 420,000;

+ Industrial design: 300,000 VND;

+ Brand: 300,000 VND;

+ Geographical indications (including appellations of origin): 420,000;

+ Integrated circuit layout design: VND 300,000.
